Notification

The 20th July,2000

No.S.O.83/C.A.6/1974/S.24/2000. – Whereas sub-section (1) of section 24 of the Water (Prevention and Control of Pollution) Act,1974 (Central Act 6 of 1974), puts prohibition on a person not to cause or permit any poisonous, noxious or polluting matter determined in accordance with such standards as may be laid down by the State Pollution Control Board to enter (whether directly or indirectly) into any stream or well or sewer or on land;

And whereas the prohibition contained in sub-section (1) of section 24 of the said Act are applicable to all persons except those which are exempted on the recommendations or in consultation with the State Pollution Control Board ;

And whereas while issuing Information Technology Policy,2000, it has been observed that Information and Technology Software Industries and certain Information and Technology Hardware Industries are not causing any water pollution ;

Now, therefore, in exercise of the powers conferred by sub-section (3) of section 24 of the Water (Prevention and Control of Pollution) Act,1974 (Central Act 6 of 1974) and all other powers enabling him in this behalf, the Governor of Haryana on the recommendation of the Haryana State Pollution Control Board, hereby exempts the following persons from the operation of sub-section (1) of section 24 of the said Act, namely :-

(1) Persons establishing or taking steps to establish Information Technology Software Industries, from the Consent Management :

Provided that where the number of workers in such industries exceeds 300 and there exist no sewerage facilities, no exemption shall be available.

(2) Persons establishing or taking steps to establish Information Technology Hardware Industries, form the Consent Management except those having electro-plating, heat treatment and painting processes :

Provided that where the number of workers in such industries exceeds 300 and there exist no sewerage facilities, no exemption shall be available.
